Agreement
These terms are an agreement between you and Yairix Studio (“we”, “us”), the developer of Lumo Accessibility Toolbar (“the app”, including the toolbar it adds to your site). By installing or using the app, you agree to these terms. If you install it for a business, you confirm that you may accept these terms on its behalf. If you don’t agree, don’t install or use the app.
Your use of Wix and the Wix App Market is also governed by Wix’s own terms. Our privacy policy explains how the app handles data.
License
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on Wix sites you own or manage, for your own business purposes, in line with these terms.
Plans
- Free: every feature, for sites with up to 5,000 unique visitors in the last 30 days.
- Pro: $4.99 a month, or $48.96 a year, with no visitor limit.
Visitors are counted from your site’s own Wix analytics, as unique visitors in the last 30 days, when you open the app in your dashboard. If a site on the Free plan passes the limit, the toolbar keeps working for every visitor, and shows a small “unlicensed” mark next to its button and a line in its panel that points the site owner to the upgrade. The mark is updated when you open the app, and it comes off within a few minutes after you buy Pro. If the count can’t be read, the site isn’t marked.
Paid plans are sold and billed by Wix through the Wix App Market: Wix handles payment, renewal, cancellation and refunds under its own terms. If we change a price or a plan’s limits, we will give advance notice, and a new price applies only from a billing period that starts after the notice. If a paid plan ends, the Free plan’s limit applies.
Requirements
The app works with Wix sites that can use Custom Code, because it adds the toolbar as a Custom Code snippet. You need the authority to grant the app the permissions it asks for (to manage your site’s Custom Code and the app’s embedded scripts, to read your site’s analytics, and to read basic site details) on each site where you install it. The toolbar and the dashboard are available in Hebrew, English, Spanish, Portuguese and French.
What the app changes
When you save, the app adds or updates one snippet in your site’s Custom Code, in the head of every page, with your settings. When you buy or change a plan, or open the app’s page, it may update that snippet’s “over the limit” flag. It can also turn off an older embedded script of the same toolbar. It changes nothing else on your site.
The toolbar changes how pages look in a visitor’s browser while an adjustment is on, for example colors, font size or zoom. It doesn’t change your site’s content. Some designs, custom code or third-party widgets may display differently under an adjustment; check your key pages with the toolbar.
Uninstalling the app doesn’t remove the snippet. It stays in your site’s Custom Code until you turn it off or delete it there.
Your site’s accessibility
The app helps visitors adjust how your site is displayed. It doesn’t make a site accessible, and it doesn’t make a site compliant with any law, regulation or standard, including Israel’s Equal Rights for Persons with Disabilities regulations, standard IS 5568 or the WCAG guidelines. Your site’s accessibility depends on its design, content and code. You remain solely responsible for your site’s accessibility, for your accessibility statement and its contents, for handling accessibility reports, and for any legal duty that applies to you. We make no promise that using the app will prevent a complaint, claim or penalty.
Acceptable use
You agree not to:
- use the app in breach of any law, or claim on your site that the app makes it accessible or compliant;
- use the app on sites that you have no right to manage;
- copy, modify, distribute, sell or rent the app or the toolbar file, or reverse engineer them, except where the law expressly allows this;
- edit the toolbar’s snippet to remove or hide the “unlicensed” mark, or otherwise get around the Free plan’s limit;
- try to gain unauthorized access to the app, to Wix systems or to other sites’ data, or interfere with how the app or Wix works;
- remove any proprietary notices from the app.
Availability and changes
We work to keep the app useful and reliable, but we don’t promise that it will always be available, error-free or compatible with every site, design or browser. The app depends on Wix APIs, the Wix platform and Google Cloud Storage, which may change or be unavailable. We may update, change or discontinue the app or any feature at any time. If we decide to discontinue the app, we will try to give reasonable notice through the app or this website.
Intellectual property
The app, the toolbar, their code, design, name and logo belong to Yairix Studio and its licensors and are protected by law. Icons in the toolbar come from Lucide, under its ISC license. These terms give you a license to use the app, not ownership of it. If you send us feedback or ideas, we may use them freely without any obligation to you.
Wix and other third parties
The app is an independent product. It is not made, affiliated with or endorsed by Wix.com Ltd. Wix is a trademark of Wix.com Ltd. Wix is not a party to these terms and is not responsible for the app. The toolbar file is delivered by Google Cloud Storage; Google is not a party to these terms either. Third-party services are governed by their own terms and policies, and we are not responsible for them.
No warranty
To the fullest extent permitted by law, the app is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accessibility or legal compliance, and non-infringement. We don’t warrant that the app will meet your requirements or your visitors’ needs.
Limitation of liability
To the fullest extent permitted by law, Yairix Studio will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, sales, data, goodwill or business opportunity, or for any complaint, claim, fine or penalty about your site’s accessibility, arising from or related to the app or these terms, even if we were told such damages were possible. Our total liability for all claims related to the app or these terms is limited to the greater of the amount you paid for the app in the twelve months before the event that gave rise to the claim, or one hundred US dollars (US$100). Some jurisdictions don’t allow certain limitations; in that case, these limitations apply to the maximum extent the law allows. Nothing in these terms limits liability that cannot be limited by law.
Indemnity
To the extent permitted by law, you agree to indemnify and hold Yairix Studio harmless from claims by third parties arising from your breach of these terms, from your site’s content or accessibility, or from statements you make about your site’s accessibility.
Termination
You can stop using the app at any time: turn the toolbar off on the app’s page, then uninstall the app from your Wix site; a paid plan is cancelled through Wix. Uninstalling ends the app’s access to your site immediately. The toolbar’s snippet stays in your site’s Custom Code until you turn it off or delete it there. We may suspend or end your access to the app if you breach these terms, if required by law or by Wix, or if we discontinue the app. The sections on what the app changes, your site’s accessibility, intellectual property, no warranty, limitation of liability, indemnity and governing law continue to apply after termination.
Governing law
These terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. The competent courts in Jerusalem, Israel will have exclusive jurisdiction over any dispute arising from these terms or the app, unless mandatory law where you live gives you the right to bring the case elsewhere.
Changes to these terms
We may update these terms from time to time. We will post the new version on this page with a new effective date. If a change is material, we will highlight it here before it takes effect. If you keep using the app after the change takes effect, you accept the updated terms; if you don’t agree, uninstall the app.
General
These terms and the privacy policy are the entire agreement between you and us about the app. If any part is found unenforceable, the rest stays in effect. If we don’t enforce a right, we don’t waive it. You may not transfer your rights under these terms without our consent; we may transfer ours as part of a reorganization or sale of the app.
