Agreement
These terms are an agreement between you and Yairix Studio (“we”, “us”), the developer of Back in Stock Insights (“the app”). By installing or using the app, you agree to these terms. If you install it for a business, you confirm that you may accept these terms on its behalf. If you don’t agree, don’t install or use the app.
Your use of Wix and the Wix App Market is also governed by Wix’s own terms. Our privacy policy explains how the app handles data.
Free license
The app is provided free of charge. We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on Wix sites you own or manage, for your own business purposes, in line with these terms. If we introduce paid plans in the future, they will be offered through Wix’s billing with advance notice, and you choose whether to upgrade.
Requirements
The app works with Wix sites that use Wix Stores. To get useful results, your store needs to collect back-in-stock requests. You need the authority to grant the app the permissions it asks for on each site where you install it.
Acceptable use
You agree not to:
- use the app in breach of any law, including privacy, consumer-protection and anti-spam laws;
- copy, modify, distribute, sell or rent the app, or reverse engineer it, except where the law expressly allows this;
- try to gain unauthorized access to the app, to Wix systems or to other sites’ data, or interfere with how the app or Wix works;
- use the app to build a competing product, or to scrape or collect data beyond your own store;
- remove any proprietary notices from the app.
Your store and your customers
Your store data stays yours. The app only reads it, in your browser, to show you the dashboard; we don’t receive or store it, as described in the privacy policy. You are responsible for having a lawful basis for the data your store collects (including back-in-stock requests), for your own privacy notice to your customers, and for how you use what the app shows you, including any CSV files you export and any messages you send to customers.
Estimates are informational
Figures such as “expected value”, “expected sales”, conversion rates, requester revenue and time to purchase are estimates derived from the data in your store. They depend on factors the app can’t see, for example a customer buying with a different email or offline, small sample sizes, and the purchase window you choose. Wix does not record when a back-in-stock email was sent, so purchase windows are measured from the request date. These figures are provided for information only. They are not financial, purchasing or business advice, and they are not a forecast or a guarantee of future sales. You are solely responsible for your restocking, pricing and business decisions.
Availability and changes
We work to keep the app useful and reliable, but we don’t promise that it will always be available, error-free or compatible with every site. The app depends on Wix APIs and the Wix platform, which may change or be unavailable. We may update, change or discontinue the app or any feature at any time. If we decide to discontinue the app, we will try to give reasonable notice through the app or this website.
Intellectual property
The app, its code, design, name and logo belong to Yairix Studio and its licensors and are protected by law. These terms give you a license to use the app, not ownership of it. If you send us feedback or ideas, we may use them freely without any obligation to you.
Wix and other third parties
The app is an independent product. It is not made, affiliated with or endorsed by Wix.com Ltd. Wix and Wix Stores are trademarks of Wix.com Ltd. Wix is not a party to these terms and is not responsible for the app. Third-party services, including Wix, are governed by their own terms and policies, and we are not responsible for them.
No warranty
To the fullest extent permitted by law, the app is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don’t warrant that the app’s results will be accurate or complete, or that the app will meet your requirements.
Limitation of liability
To the fullest extent permitted by law, Yairix Studio will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, sales, data, goodwill or business opportunity, arising from or related to the app or these terms, even if we were told such damages were possible. Because the app is free, our total liability for all claims related to the app or these terms is limited to one hundred US dollars (US$100). Some jurisdictions don’t allow certain limitations; in that case, these limitations apply to the maximum extent the law allows. Nothing in these terms limits liability that cannot be limited by law.
Indemnity
To the extent permitted by law, you agree to indemnify and hold Yairix Studio harmless from claims by third parties (including your customers) arising from your breach of these terms or your use of data from your store in breach of the law.
Termination
You can stop using the app at any time by uninstalling it from your Wix site. Uninstalling ends the app’s access to your site’s data immediately; since we store none of it, there is nothing for us to delete. We may suspend or end your access to the app if you breach these terms, if required by law or by Wix, or if we discontinue the app. The sections on estimates, intellectual property, no warranty, limitation of liability, indemnity and governing law continue to apply after termination.
Governing law
These terms are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. The competent courts in Jerusalem, Israel will have exclusive jurisdiction over any dispute arising from these terms or the app, unless mandatory law where you live gives you the right to bring the case elsewhere.
Changes to these terms
We may update these terms from time to time. We will post the new version on this page with a new effective date. If a change is material, we will highlight it here before it takes effect. If you keep using the app after the change takes effect, you accept the updated terms; if you don’t agree, uninstall the app.
General
These terms and the privacy policy are the entire agreement between you and us about the app. If any part is found unenforceable, the rest stays in effect. If we don’t enforce a right, we don’t waive it. You may not transfer your rights under these terms without our consent; we may transfer ours as part of a reorganization or sale of the app.
